Transition Options
Transition Options for Existing Generators Projects of any renewable technology that have a capacity of 500 kW or less and were purchased or were in service by 11:59 p.m. on October 1, 2009 are eligible to transition to the FIT and microFIT Programs. They will be deemed to have met the domestic content requirements. Generators who have not been operating under an OPA contract will receive a 20-year FIT or microFIT contract. Generators who have been operating under a RESOP contract will obtain a contract representing the balance of the 20-year FIT or microFIT contract.
Micro RESOP projects 10 kW and less that were purchased or were in service by October 1, 2009 will be required to sign a RESOP to microFIT Transition Agreement. This form, posted below will allow the OPA to terminate the RESOP contract when the microFIT contract is executed. This form should be signed and submitted to the OPA by November 30, 2009. The completed form can be emailed to the OPA at fit@powerauthority.on.ca. Once you have received a copy of the executed form from the OPA, you must submit a microFIT application. On the microFIT application form, select "no" when you are asked whether you have an existing OPA contract. When you are filling out the project description box, please note that you have submitted a transition agreement and provide your RESOP contract number.
Some projects will be required to terminate their RESOP contract to be eligible for the FIT or microFIT Program. If you have a RESOP contract for a project that is not yet in service and was not purchased by October 1, 2009 and you wish to be eligible for the FIT or microFIT Program, you must fill out and sign the prescribed form posted below. This form will allow you to terminate your RESOP contract. The form must be signed and submitted to the OPA by 11:59 p.m. on November 30, 2009. It can be emailed to the OPA at fit@powerauthority.on.ca.
On October 1, 2009, the OPA offered a contractual amendment to RESOP contract holders for proposed wind power projects that had obtained a certificate of approval from the Ministry of the Environment. This contractual amendment provided these proposed projects with an enhanced price and relieved proponents from requirements to share any potential ecoENERGY payments with the OPA. In exchange, proponents were required to provide the OPA with completion and performance security and commit to bringing the proposed facility into commercial operation no later than December 31, 2010, with liquidated damages payable each day commercial operation is late. The OPA made an equivalent offer available to proponents of proposed RESOP projects that used biogas, biomass and water as their generation source. To be eligible, the projects must have possessed either a certificate of approval and/or a permit to take water or a renewable energy approval from the Ministry of the Environment.
