Until a notice to proceed is issued, the OPA has the option of terminating the FIT contract with liability capped at the pre-construction liability limit. This is the maximum amount of pre-construction development costs that the OPA will pay you in the event the OPA terminates your FIT contract. Similarly, you will be compensated if the OPA delays the issuance of the notice to proceed.
